These Terms & Conditions ("Terms") govern your use of Pixel Game Lab (the "Service"), provided by Game Design Academy LLC ("Game Design Academy," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. Because the Service is used by children, a parent, legal guardian, teacher, or program administrator accepts these Terms on the child's behalf. If you do not agree, do not use the Service.
Student accounts are created only by an authorized administrator or teacher; students may not sign up on their own. Personal subscriber accounts may be created through the Service's sign-up page. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Demo accounts may be offered with limited functionality and are described further below.

We use automated filtering together with human review to help keep the Service safe for children. We may remove any content, and suspend or terminate any account, that violates these Terms.
Your Content. You retain ownership of the concept art, pixel art, levels, games, and other creations you make using the Service ("Your Content"), and you keep the right to use Your Content however you like outside the Service. By using the Service, you grant Game Design Academy LLC a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, adapt, and display Your Content as needed to operate, provide, promote, and improve the Service — including assembling it into game packages, publishing games to our games catalog, and, where you choose to share Your Content to the community, allowing other users to download and reuse it within their own creations in the Service. This license continues for any copies that have been published or that other users downloaded before you removed Your Content; you can stop sharing or delete Your Content at any time, but we cannot recall copies others already downloaded.
You represent that Your Content is your own original work (or that you have the rights to use it), that it does not infringe anyone else's rights, and that it complies with these Terms.
Our intellectual property. The Service itself, including the Pixel Game Lab software, game engine, editing tools, website, designs, logos, and trademarks, and any built-in library content we provide (such as starter art, tiles, characters, sounds, music, templates, and sample games, the "PGL Library"), is owned by Game Design Academy LLC or its licensors and is protected by intellectual-property laws. When you use PGL Library content in your creations, we grant you a limited license to use it only within the Service as part of Your Content; you do not own the PGL Library content and may not extract, copy, redistribute, sell, or use it outside the Service. Except as permitted by law, you may not copy, modify, reverse-engineer, or attempt to extract the Service's software, engine, or library assets.
Pixel Game Lab is used by children, and we work to keep it safe. We provide several safeguards, and we may use any of them at our discretion:
Repeat offenders. Accounts that repeatedly violate these Terms — including repeat copyright or trademark infringers — will have their access terminated.
We respect the intellectual-property rights of others and expect our users to do the same. If you believe that content on the Service infringes a copyright you own or control, you may send a written notice to our designated copyright agent. Your notice must include:

We will respond to valid notices by promptly removing or disabling access to the material in question, and we terminate the accounts of repeat infringers. If you believe your content was removed by mistake, you may send a counter-notice to the same address, and we will follow the process required by applicable law.
Pixel Game Lab offers a free Demo plan and three paid subscription plans. Each plan sets how much you can create or download in the app (a storage limit for each type of item); higher plans raise those limits and unlock more features. The limits count the items you create and the ones you download from the community; built-in PGL Library items and school class work do not count against your limits.
Demo - Free. A free plan for trying the tools. Includes up to 1 character, 1 boss, 1 tile, 1 decoration, 1 concept art, 1 level, and 1 game. Advanced ("Complex") creations are included, but publishing and community features are not. Demo creations may be limited, reset, or removed (see Demo Accounts below).
Standard - $1.99/month or $19.99/year. Create or download up to 20 characters, 5 bosses, 50 tiles, 20 decorations, 20 concept arts, 10 levels, and 5 games. Unlocks advanced (Complex) creations, publishing games to the games catalog, and community features.
Extended - $3.99/month or $39.99/year. Create or download up to 50 characters, 15 bosses, 120 tiles, 50 decorations, 50 concept arts, 30 levels, and 15 games. Includes all Standard features.
Pro - $9.99/month or $99.99/year. Create or download up to 120 characters, 50 bosses, 300 tiles, 150 decorations, 120 concept arts, 100 levels, and 50 games. Includes all Standard features.
Billing & renewal. Paid subscriptions are billed through the payment method available on the platform where you subscribe. Subscriptions renew automatically for the same plan and period until you cancel; fees are charged at the start of each billing period; and you may cancel at any time to stop future renewals, keeping your plan until the end of the period you already paid for. Except where required by law, fees already paid are non-refundable.
Changing plans. You can change your plan at any time. When you change an active paid subscription, the change takes effect right away and any unused time on your current plan is credited toward the new one, so you only pay the difference. If you move to a lower plan and already have more items than it allows, your extra items are not deleted, they are kept but become view-only until you are back within the limit or upgrade again.
Purchases require an adult. Subscriptions and licenses are intended to be bought and managed by a person 18 or older. On the website, a child's paid access can be bought only by a connected parent or guardian on the child's behalf. In our apps, any purchase on a child's account must be completed by a parent or guardian through the parental gate (and, where enabled, the family purchase-approval controls of the device). Prices, plans, and limits may change with notice.
We may offer demo accounts so new users can try the Service. Demo accounts have limited features and storage, are intended for evaluation only, and may be reset, cleared, or removed at any time without notice. Creations made in a demo account are not guaranteed to be saved or recoverable.
We may suspend or terminate your access to the Service if you violate these Terms or if we discontinue the Service. You may stop using the Service at any time. School and program accounts may be removed by the responsible administrator. Upon termination, your right to use the Service ends, and we may delete associated data as described in our Privacy Policy.
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
To the fullest extent permitted by law, Game Design Academy LLC and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data or creations, arising out of or relating to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us, if any, in the twelve months before the claim.
These Terms are governed by the laws of the United States and the state in which Game Design Academy LLC is organized, without regard to conflict-of-law principles. Any disputes will be resolved in the courts located in that jurisdiction.
